Terms and Conditions of Sale

1. Seller and scope

These terms and conditions of sale (the “Terms”) apply to all sales made on the website diamina.eu and, more generally, to all sales of the Diamina brand, whatever the channel (website, telephone, email, social media or appointment).

The seller is Diamina S.L.U., Rambla Catalunya 18, 6th floor, 08007 Barcelona (Spain), Tax ID (NIF) B65984965, EU VAT number ESB65984965, email: [email protected].

By placing an order, you accept the Terms in force on the date of the order. They are available at all times on the website and are sent to you with the order confirmation.

2. Products

We sell diamonds, gemstones and jewellery in precious metals.

  • Natural diamonds (Diamina). Our diamonds are natural diamonds. Their origin is always clearly indicated.
  • Certificates. When a stone is sold with a certificate (GIA, IGI or another laboratory), its characteristics are those stated in the certificate. The certificate is delivered with the stone.
  • Photos and videos. They are as accurate as possible, but colour and brilliance may vary slightly depending on the screen and lighting.
  • Made-to-order jewellery. Most of our jewellery is made to order, according to the customer’s choices (stone, metal, ring size, engraving…).
  • Availability. A stone may cease to be available between your order and our confirmation. In that case, we will offer you an equivalent stone or a full refund.

3. Prices

Prices are shown in euros, including all taxes (VAT included), except for professional customers, to whom they are shown excluding taxes (see section 10). Delivery charges and, where applicable, insurance are shown before you confirm your order. The price of stones may change at any time, but the applicable price is the one displayed when you place your order. In the event of an obvious pricing error (for example, a derisory price due to a technical error), we may cancel the order and refund you in full.

For deliveries outside the European Union, import duties and taxes may be charged by the destination country. They are not included in our prices and are payable by the customer.

4. Orders

Your order is registered when you confirm it on the website, or when you accept in writing a quotation we have sent you. We then send you a confirmation by email. The contract is concluded upon receipt of this confirmation. For made-to-order jewellery, manufacturing begins after confirmation and payment of the deposit or the price.

5. Payment

You can pay by bank card, Bizum, bank transfer or any other method offered when ordering. Depending on the product, payment may be made in full or with a deposit, the balance being due before shipment; the payment schedule is shown when ordering.

Cash payment is only possible in person and within the legal limits: less than €1,000 per transaction, or less than €10,000 for a private individual who proves tax residence outside Spain.

The jewellery remains our property until the price has been paid in full.

6. Identity verification

As a dealer in jewellery, gemstones and precious metals, we are subject to anti-money laundering regulations. For any purchase equal to or above the regulatory threshold (currently €1,000), we must verify your identity before delivery. After your order, we send you a secure link to provide a photo of your identity document. Payment must come from an account or card in your name.

Delivery can only take place once this verification has been completed. If you do not provide the requested information, or if the verification cannot be completed, we may cancel the order and refund the amounts paid, except for costs already incurred for made-to-order jewellery. The processing of this data is described in our privacy policy.

7. Manufacturing and delivery

Lead times. The manufacturing time is shown on the product page and confirmed by email after the order. It is in addition to the shipping time. Unless otherwise stated, delivery takes place no later than 30 working days after receipt of payment (or of the deposit, in the case of payment in instalments). If we cannot meet the announced lead time, we will inform you; you may then grant us additional time or cancel the order and receive a full refund.

Destinations. We deliver to the countries offered when ordering.

Shipping. Jewellery is shipped by secure carrier, with tracking. Proof of identity may be requested upon delivery.

Receipt. Check the condition of the parcel upon delivery. If the parcel is opened or damaged, note your reservations with the carrier and inform us as soon as possible.

Risk. For consumers, the risk of loss or damage passes to you when you (or a person designated by you) take physical possession of the jewellery.

Hand delivery. With our agreement, the jewellery may be handed to you in person. An original identity document will then be required.

8. Right of withdrawal

Principle. If you are a consumer, you have 14 days to withdraw from the contract without giving any reason. This period starts on the day you (or a person designated by you, other than the carrier) receive the product.

Exceptions. In accordance with Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods made to your specifications or clearly personalised: jewellery made to order according to your choices (stone, metal, size, model), and jewellery resized, engraved or modified at your request.

The right of withdrawal therefore applies in particular to loose stones and to unmodified jewellery from stock.

How to withdraw. Inform us of your decision before the end of the period by a clear statement (email to [email protected] or letter), for example using the form in the appendix (its use is not mandatory).

Returning the product. Return the product without undue delay and no later than 14 days after informing us of your decision, to the address we will give you, in its original condition, with its certificate, box and accessories. Return costs are borne by you. Given the value of the products, we recommend an insured and tracked shipment: the product travels at your risk until we receive it. You may handle the product as you would in a shop to examine it; you may be liable for any diminished value resulting from other handling (wearing the jewellery, scratches, knocks, loss of the certificate…).

Refund. We will refund all payments received, including the initial delivery costs (except any supplement for a delivery method more expensive than the standard delivery you chose), within 14 days of receiving your decision. We may withhold the refund until we have received the product or proof that it has been sent back. The refund is made using the same payment method as the order, unless otherwise agreed, at no cost to you.

9. Legal guarantees

Legal guarantee of conformity. If you are a consumer, you benefit from the legal guarantee of conformity for 3 years from delivery. If the product does not match the order or has a defect, you can obtain its repair or replacement free of charge; if that is not possible, a price reduction or termination of the contract. During the first two years, any lack of conformity is presumed to have existed at the time of delivery. This guarantee applies without prejudice to any more favourable rights granted to you by the law of your country of residence.

What is not covered. Normal wear and tear (scratches, polishing of the metal, deformation of a thin ring), knocks, accidents, loss of a stone following a knock, and work carried out by a third party.

How to claim. Contact us at [email protected] describing the problem, with photos. We will tell you how to send the jewellery back to us; shipping costs are then paid by us.

10. Professional customers

Sales to professionals (jewellers, wholesalers, designers) are governed by these Terms, with the following adaptations:

  • access to professional conditions requires opening a professional account, approved after verification of the company’s file (identification of the company, its representative and its beneficial owners);
  • professional prices are shown excluding taxes; Spanish VAT is added for businesses established in Spain; the intra-EU VAT exemption only applies with a valid VAT number verified in the VIES system;
  • there is no right of withdrawal;
  • the guarantee of conformity is that of the Spanish Commercial Code: any apparent defect must be reported within 4 days of receipt, and any hidden defect within 30 days of receipt;
  • any handling, alteration or setting of a stone by the professional or by a workshop acting on their behalf is at their sole risk: a professional is deemed to know the risks of handling diamonds, precious and semi-precious stones, and any resulting damage (chips, fractures, scratches) is not covered;
  • risk passes when the parcel is handed to the carrier, unless otherwise agreed;
  • any dispute falls under the exclusive jurisdiction of the courts of Barcelona.

11. Personal data

The data collected during your order is processed by Diamina S.L.U. in accordance with our [Privacy Policy].

12. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer residing in another country, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings before the courts of your domicile.

For any complaint, please contact us first at [email protected]: we reply within one month at the latest. If no amicable solution is found, you may refer the matter free of charge to a consumer mediation body or to the consumer authority of your country.
